NextEra Energy Services' Privacy Policy

Thank you for using NextEra Energy Services. NextEra Energy Services operates through various legal entities and their affiliates including NextEra Energy Services Gas, LLC (dba Symmetry Energy Solutions) (collectively herein “NextEra Energy Services,” “we,” “us,” or “our”) to provide retail electric, retail natural  gas, and related energy services in states open to retail gas and/or retail electric competition, including any associated products, services, websites, and mobile applications (collectively, the “Services”).

This Privacy Policy describes how NextEra Energy Services collects, processes, and retains information that is linked or reasonably linkable to you (“Personal Data”), including in connection with the website from which this Privacy Policy is linked. This Privacy Policy also describes the rights you may have regarding our processing of your Personal Data under applicable local law. By using the Services, you agree to the processing of your Personal Data as set forth in this Privacy Policy.
 

Personal Data We Collect and Disclose

Depending on the Services you interact with, Personal Data that we may collect includes:

  • Identifiers, including your name, telephone number, email address, Internet Protocol address, government identifiers (e.g., Social Security number), account credentials (e.g., account log-in information), or other similar identifiers.
  • Commercial information, including your purchase history and tendencies as well as records of products or services you may have considered or obtained.
  • Internet or other similar network activity, including browsing history, search history, or information regarding your interaction with the Services.
  • Geolocation Information, including information about your physical location (e.g., country and/or state) or movements when you access the Services.
  • Profiles and Inferences, including inferences drawn to create a profile reflecting your preferences, interests, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, or aptitudes.
  • Sensitive Information, including payment information and precise geolocation information.
  • Information You Otherwise Submit to Us

We may collect the categories of Personal Data described above directly from you, automatically through your use of the Services, and from third parties.

Information We Collect Directly From You: We collect Personal Data you choose to provide as part of your interaction with the Services (e.g., information you submit using our forms to contact us, complete a survey or questionnaire, or enroll in services).

When you are asked to provide Personal Data, you may decline. But if you choose not to provide data that is necessary for us to provide certain services or perform our contractual obligations, we may not be able to provide you with those services or perform those contractual obligations. 

If you provide or permit us to collect any Personal Data relating to another person, you are telling us that you have the authority to share that data and to permit us to use the data as described in this Privacy Policy.

Information We Collect Automatically: We and our partners may automatically collect certain technical Internet or other similar network activity information from your computer or mobile device over time and across different websites when you use the Services, such as your Internet Protocol address, your general geographic location, your browser type, your operating system, the pages you view on the Services, the pages you view immediately before and after you access the Services, and the search terms you enter on the Services.

Information We Collect from Other Sources: We may collect Personal Data about you from third parties, such as public databases or social media platforms. For example, if you access the Services by clicking a link on a third-party site, we may collect information, such as the domain name of that third-party service.
 

How We Use Personal Data

NextEra Energy Services may use Personal Data we collect about you for purposes including to:

  • Fulfill your requests for the Services, respond to inquiries about the Services and offer other products, programs or services that may be of interest
  • Provide you with information about the Services or required notices
  • Enhance your experience on our websites
  • Send electronic newsletters, blogs, and marketing communications
  • Enable you to participate in polls, surveys, sweepstakes, contests, and other promotions
  • Allow us to improve the Services, such as by better tailoring our content to our users’ needs and preferences, and develop new offerings
  • Generate and analyze research and statistics about your use of the Services, including to improve our forecasting models
  • Detect, prevent, and respond to fraud, intellectual property infringement, violations of our Terms of Service, violations of law, or other misuse of the Services
  • Comply with law enforcement or government authority requests and comply with law.

We may also anonymize or de-identify your Personal Data in such a way that you may not reasonably be re-identified and may use this anonymized/de-identified information for any other purpose. To the extent we de-identify any data originally based on Personal Data, we will maintain and use such data only in de-identified form and will not attempt to reidentify the data except as permitted under applicable law.
 

How We Disclose Personal Data

We may disclose the categories of Personal Data described above to the following categories of entities:

  • Affiliates. We may disclose Personal Data we collect about you to other NextEra Energy Services companies for the purposes described in this Privacy Policy.
  • Service Providers. We may disclose Personal Data we collect about you with our service providers for the purposes described in this Privacy Policy. For example, we engage vendors to help us with order and payment processing, email and SMS, marketing communications, data analytics, and co-sponsoring sweepstakes, contests, or promotions.
  • Utility Providers. We may disclose Personal Data to electricity and natural gas providers, utilities, and other companies to identify energy usage and/or cost saving opportunities.
  • Business Partners. We may disclose Personal Data to our business partners that may deliver marketing communications, promotional materials, or advertisements that may be of interest to you, including advertisements based on personal data obtained or inferred over time from your activities across non-affiliated websites, applications, or online services.
  • Business Transfers. We reserve the right to disclose and/or transfer Personal Data to a third party in connection with a merger, acquisition, sale (including any transfers made as part of insolvency or bankruptcy proceedings), or other transaction in which the third party assumes control of all or part of NextEra Energy Services’ assets. We may also disclose your information to companies that were formerly wholly or partly included in the NextEra Energy Services group to whom we provide services during a transition period following separation.
  • In Response to Legal Process. We may disclose Personal Data we have collected about you where we believe necessary to comply with a regulatory requirement, judicial proceeding, court order, government request, or other legal process served on us.
  • To Protect Us and Others. We may disclose Personal Data we collect about you where we believe it is appropriate to do so to prevent, detect, protect against, or respond to security incidents, identity theft, suspected fraud, harassment, malicious or deceptive activities, violations of law, other misuse of the Services, or situations involving potential threats to the life or physical safety of our customers, the public, NextEra Energy Services and our affiliates, violations of our Terms of Service or this Privacy Policy, or as evidence in litigation in which we are involved.

We do not sell Personal Data, including as the term “sale” or “sell” may be defined under applicable state privacy laws. We also do not knowingly sell or share the personal information of any individual under 16 years of age. However, when you use websites or mobile applications associated with the Services, our authorized partners may collect cookies and similar technologies and may use this data to deliver or measure advertising or content. Depending on applicable law, this activity may be considered targeted advertising, sharing, or other processing subject to an opt-out right. You can make choices to allow or prevent such uses as described in the “Cookies and Similar Technologies” and “Individual Rights” sections below.
 

Information Collected Automatically via Cookies and Similar Technologies

When you visit any of our websites or other digital properties or interact with our email communications, we, our service providers, and third-party advertising technology providers (e.g., Google, LinkedIn, Meta), use cookies, pixels, beacons, scripts, session replay, and similar technologies to collect information about you, your devices, and how you use the websites or digital properties, such as actions taken after clicking on an advertisement, or how you navigate our websites. We use this information to optimize our websites and to deliver, measure, and improve digital marketing campaigns over different browsers and devices you use (e.g., by showing you personalized advertisements, optimizing campaigns for better conversions, and measuring the effectiveness of our marketing efforts). The providers of these technologies may also use the information collected for their own purposes, including marketing.  Some of this information may be considered personal information under data privacy laws. Cookies are small text files that your browser stores on your computer or mobile device when you visit a website. When you return to a website you have visited before, your browser gives this data back to the website to help it remember your preferences and personalize your experience; enhance website performance and security; and enable interest-based advertising. Retention Period

We will retain your Personal Data for the time necessary for the purpose(s) for which it was obtained and as outlined in this Privacy Policy. The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you;
  • Whether there is a legal obligation to which we are subject; and
  • Whether retention is advisable considering our legal position in, for example, the enforcement of applicable contractual agreements or statutes of limitations, litigation, or regulatory investigations.
     

Individual Rights

Depending on where you live and subject to certain exceptions, including if you are a resident of a state with an applicable consumer privacy law such as Nebraska or New Jersey, you may have the right to exercise certain rights involving Personal Data we hold about you. These may include the right to:

  • Right to Access. The right to access your Personal Data held by us.
  • Right to Data Portability. The right to receive a copy of your Personal Data or transfer your Personal Data, when possible.
  • Right to Correct. You have the right to correct inaccurate Personal Data and, taking into account the purpose of processing, to ensure it is complete.
  • Right to Delete. You have the right to have your Personal Data erased or deleted.
  • Right to Opt-Out of Targeted Advertising or Other Opt-Out Processing. You may have the right to opt out of targeted advertising, profiling in furtherance of decisions that produce legal or similarly significant effects, or other processing for which an opt-out right is provided under applicable law. Because we do not sell Personal Data, we do not offer a sale opt-out except to the extent a particular use is deemed a “sale” under applicable law.
  • Right to Opt-Out of Certain Automated Processing (“Profiling”). You may have the right to opt out of certain automated processing of your Personal Data in furtherance of decisions that produce legal or similarly significant effects.
  • Right to Appeal. The right to appeal our decision with respect to the handling of your rights request.
  • Right to Withdraw Consent. The right to withdraw your consent to the extent it is the basis for our processing of your Personal Data.

To exercise rights you may have to opt out of targeted advertising, profiling, or other opt-out processing under applicable law, please use the Privacy Policy Request Form on the website. We do not currently respond to web browser “do not track” signals. Where required by applicable law, we consider your user-enabled privacy controls, such as a browser plugin or privacy setting, to signal your opt-out choices. If you use a browser that does not transmit your privacy control or use a browser or device that you have not associated with an opt-out preference, please use the Privacy Policy Request Form to register your opt-out preference.

If you would like to exercise other rights you may have under applicable law, please use our Privacy Request Form or contact us using the details listed below in the “Contact Us” section. You may be asked to provide certain information when submitting your request including your relationship with NextEra Energy Services, first and last name, email address, or telephone number for us to determine if your information is in our systems.

We will further verify and respond to your request consistent with applicable law, considering the type and sensitivity of the Personal Data subject to the request. We may need to request additional Personal Data from you to protect against fraudulent or spoofed requests. Please note that we may need to retain certain Personal Data for recordkeeping purposes or to complete any transactions that you began prior to requesting a change or deletion.

Depending on where you are located, you may also submit your rights requests via an authorized agent. Authorized agents may submit requests through the methods listed above. When a request is submitted by an authorized agent, we may require the authorized agent to provide evidence of its authority to act, which may include evidence of the authorized agent’s identity and signed permission provided by such individual. We may also contact you to verify that you provided permission to submit the request.

How We Protect Personal Data

We use administrative, technical and physical safeguards designed to protect against unauthorized disclosure, use, alteration or destruction of Personal Data. No such measure is ever 100% effective, so we do not guarantee that your Personal Data will be secure from theft, loss, or unauthorized access or use, and we make no representation as to the reasonableness, efficacy, or appropriateness of the measures we use to safeguard such data. Moreover, we are not responsible for the security of personal data you transmit to the Services over networks that we do not control, including the Internet and wireless networks. NextEra Energy Services is not responsible for the functionality or security measures of any third-party product or service you use or access, including energy providers, utilities, and SMTP.
 

NextEra Energy Services Advertisements

We may send periodic e-mails informing customers of offers related to a service they requested. Individuals who do not wish to receive NextEra Energy Services promotional e-mails on new products and services may click on the “unsubscribe” link at the bottom of the email or contact NextEra Energy Services at unsubscribe@nexteraenergyservices.com. Customers may not be able to choose to unsubscribe to certain mailings, to the extent the mailings are considered an essential service or required communication.
 

Minors

Our Services are intended to be used by adults only and are not directed towards children under the age of eighteen. If you are under eighteen, you are not eligible to use the Services . If you believe that we have collected Personal Data relating to children under the age of eighteen, please notify us immediately so that we may take steps to eliminate such information.
 

Changes in Our Privacy Policy

We reserve the right to alter or amend this Privacy Policy at any time to reflect changes in our online information practices. Any changes will become effective when we post the revised Privacy Policy. This Privacy Policy is effective as of the “Last Revised” date shown below. We will notify you of substantial changes to this Privacy Policy as appropriate under applicable law.

The Services may contain links to third party websites that are not subject to this Privacy Policy. Such links are provided for your convenience only and do not constitute an endorsement by us of such third-party properties. NextEra Energy Services is not responsible for how these properties operate or treat your Personal Data.
